ANTHRAX 'SUBJECT' EXPLORES FILING LAWSUIT AGAINST NYT COLUMNIST FOR 'MALICIOUS LIES'

A foreshadow of legal fireworks over what has been reported about the Department of Justice's anthrax "Subject of Interest" Steven Hatfill emerged Sunday after the germ warfare specialist declared to the cameras: "I am not the anthrax killer!"

Sources tell the DRUDGE REPORT that Hatfill has told his lawyers he wants to sue the NEW YORK TIMES and its terror columnist Nicholas Kristof for reporting last week: Hatfill has "failed three successive polygraph examinations since January."

"This is a total lie," Hatfill warned on Sunday. "I have not taken, let alone failed, three polygraphs on Anthrax since January. I had one polygraph session which the FBI did administer to me in January, and I was told I passed, and the examiner was satisfied that I had told the truth. Mr. Kristof never called me about this allegation, nor did he call my attorney."

Sources tell DRUDGE that Hatfill lawyers are actively exploring the possibility of suing Kristof, an 18-year veteran at the paper, editorial page chief Gail Collins and NYT executive editor Howell Raines.

"Mr. Kristof, why do you write such things?" Hatfill asked. "Why did you not at least check your facts or ask comment from me or my representatives? What have I done to injure you in this manner?"

Sources say the TIMES has been warned that Hatfill considers the TIMES reporting malicious, false and highly damaging.

Kristof turned up the heat with his August 13th entry "The Anthrax Files," which called Hatfill a "Mr Z" in the federal probe of last year's anthrax attacks.

"The authorities' interest in Dr. Hatfill arises from a range of factors," Kristof wrote, noting the "failed" polygraphs.

"The NEW YORK TIMES has refused to let Mr. Hatfill respond in any form... in his own words, he's offered to write an essay," said a close source.

"And then the NEW YORK TIME mocks him for holding a press conference trying to correct NEW YORK TIMES reporting? I suspect we have the makings of a tremendous civil action."

Gail Collins said that in conversations with Hatfill's lawyer on Friday she had invited Hatfill to submit a column for publication.

Responding to the criticisms of Kristof, she said, "We have confidence in our columnists."
