ACLU To Challenge Detention Of Padilla

The American Civil Liberties Union will file legal papers today in Manhattan challenging the government's decision to detain Jose Padilla in a military jail without charges or trial.

Mr. Padilla, a former Chicago gang member who is also known as Abdullah al-Muhajir, has been accused by the government of plotting to explode a radioactive bomb in the United States.

A lawyer for the A.C.L.U. said the organization planned to argue that holding Mr. Padilla without charges or a lawyer violates the Constitution's guarantee of due process.

"If the government has a case against Padilla it should charge him and try him," said Steven R. Shapiro, the A.C.L.U.'s legal director. He said the group would be joined in its friend of the court brief by its state affiliate, the New York Civil Liberties Union.
